Under Gov. Code Β§65852.2(a)(6), local agencies may prohibit short-term rental of ADUs - and Moreno Valley does so through MVMC Β§9.08.060. ADUs must be rented for terms of more than 30 days, which effectively excludes typical Airbnb/Vrbo short-term rental use. Long-term residential tenancy is permitted by right. For JADUs, the deed restriction recorded under Gov. Code Β§65852.22 expressly prohibits STR use for any period less than 31 days. ADUs cannot be sold separately from the primary dwelling unless the City has affirmatively adopted condo-conversion rules under AB 1033 (2024) - verify the current MVMC status before relying on separate sale. Long-term tenancies in ADUs are governed by the California Tenant Protection Act (AB 1482) once the tenant has been in place 12 months: rent increases are capped at 5% plus CPI (max 10%) annually, and just cause is required for eviction.
Renting an ADU for less than 31 days violates MVMC Β§9.08.060 and (for JADUs) the recorded deed restriction. Enforcement is via Code Compliance administrative citation (typical fines $100/$200/$500 escalating per Cal. Gov. Code Β§36900). Continued operation can trigger Order to Comply notices and revocation of the ADU certificate of occupancy. Operators also expose themselves to back-tax assessment if they fail to collect Transient Occupancy Tax during the period of unlawful operation.
