Full Breakdown
Lake County's Unified Development Ordinance allows an accessory dwelling unit (attached or detached) only as an accessory to a detached house on AG, RE, E, or R-1 lots of at least 80,000 square feet. An attached ADU can sit on any level of the house but can't internally exceed one story. Every ADU is capped at one bedroom and 1,000 square feet of gross floor area, must meet the same setback and impervious-coverage standards as the principal structure, and follows the accessory-structure height limits (25 to 30 feet, one story, depending on district). Only one ADU or caretaker's residence is allowed per lot. This chapter reaches unincorporated county land only. Waukegan, North Chicago, Highland Park, Gurnee, Libertyville, and other incorporated municipalities set their own ADU rules.
Violations & Fines
Building without the required Chapter 150 building permit, or occupying an ADU beyond the size/bedroom cap, is enforced as a zoning code violation subject to the county's standard UDO enforcement and building-permit remedies.
