Full Breakdown

300 implements state ADU law (Gov. 22) and makes ADU construction a ministerial, by-right approval in every zone that permits single-family or multi-family housing; no CUP or variance is needed. ft. on lots an acre or larger; attached units cap at 50 percent of the primary dwelling's square footage. Side and rear setbacks cannot exceed four feet unless fire, utility, or drainage easements require more, and converting an existing legal structure (garage, barn, pool house) needs no setback at all. Parking is limited to one space per ADU and is waived entirely within a half-mile of public transit, in a Design Review-Historic zone, when converting an existing legal parking structure, or when on-street permits aren't offered to the ADU occupant.

A junior ADU (JADU) tops out at 500 square feet built entirely inside the existing home, needs no extra parking, and must carry a recorded deed restriction barring separate sale and requiring an efficiency kitchen. Owner occupancy of one unit on the lot was suspended by state law for permits issued between January 1, 2020 and January 1, 2025; permits issued after that date require the owner to live in one of the dwellings, recorded via a notarized notice of restriction filed before the certificate of occupancy issues, except for nonprofit housing organizations, special-needs trusts, and licensed Community Care Facilities. Under the county's separate short-term rental chapter, ADUs and JADUs cannot be used as hosted or vacation home rentals.

Violations & Fines

Building beyond the by-right floor-area or setback standards without approval is a Title 130 zoning violation handled by Code Enforcement. For JADUs, the recorded deed restriction is directly enforceable: noncompliance with the no-separate-sale, owner-occupancy, or efficiency-kitchen conditions can trigger legal action against the property owner, including revocation of the right to maintain the JADU on the property.

Frequently Asked Questions

Do I need a conditional use permit to build an ADU in El Dorado County?
No. Section 130.40.300(B) makes ADU and JADU construction allowed by right in any zone that permits single-family or multi-family housing, so approval is ministerial rather than a discretionary CUP or variance process.
Can I rent my El Dorado County ADU out short-term?
No. Section 130.40.300(B) allows renting an ADU separately only for terms of 30 consecutive days or more, and the county's Hosted and Vacation Home Rental Ordinance (Section 5.56.030) expressly bars using an accessory or junior accessory dwelling unit as a hosted or vacation home rental.
Do I have to live on the property if I build an ADU?
Only if your permit is issued after January 1, 2025. State law suspended the county's owner-occupancy requirement for ADU permits issued between January 1, 2020 and January 1, 2025; after that window, Section 130.40.300(D) requires the owner to occupy one of the units, recorded by a notarized notice of restriction.
How much parking does an ADU need in El Dorado County?
At most one space per unit under Section 130.40.300(C)(4), and none at all if the ADU sits within a half-mile of public transit, is in a Design Review-Historic zone, converts an existing legal garage or carport, or is served by a nearby car-share vehicle.
