Santa Clara County complies with CA ADU mandates (Gov Code 65852.2, AB 68/881/SB 13, AB 1033). One ADU plus one JADU allowed on single-family lots up to 1,200 sq ft with ministerial approval in 60 days.
Santa Clara County allows Accessory Dwelling Units (ADUs) and Junior Accessory Dwelling Units (JADUs) on most residential lots under California Government Code 65852.2, enhanced by AB 68, AB 881, SB 13, AB 1033, and subsequent legislation. On a single-family lot, owners may build one ADU and one JADU. ADUs can be detached, attached, or conversions of existing space (garage, basement, part of home). Maximum size is 1,200 square feet for detached ADUs; attached ADUs are limited to 50 percent of the primary dwelling or 1,200 sq ft whichever is greater, with a minimum allowed size of 850 sq ft (1,000 sq ft for two-bedroom). Height limits generally 16 to 25 feet depending on lot context. Setbacks are 4 feet from side and rear property lines. Parking requirements are eliminated within 1/2 mile of transit. Owner-occupancy is not required for ADUs through 2025, though JADUs require owner occupancy of one unit. AB 1033 permits county adoption of condo-ization rules allowing separate sale of an ADU. Building permits are processed ministerially within 60 days.
