Full Breakdown
A detached garage or accessory building that already sits inside the required setback, as long as it had a final inspection before January 1, 2017, can be rebuilt or converted into an ADU in unincorporated Santa Clara County with no additional setback imposed. The county also allows expanding that structure by up to 150 square feet beyond its original footprint, provided the expansion doesn't push further into the setback. An attached garage inside an existing single-family home can likewise be converted, with independent exterior access and setbacks adequate for fire safety.
Violations & Fines
Converting without a building permit or exceeding the 150-square-foot expansion allowance voids the setback exemption and can trigger a stop-work order and permit enforcement.
