San Jose allows conversion of an existing garage to an ADU or JADU under SJMC Β§20.30.150, consistent with California Government Code Β§65852.2. No replacement parking is required when an existing garage is converted to an ADU, and the existing setbacks are preserved for the conversion footprint.
Under SJMC Β§20.30.150 and state ADU law, San Jose may not require replacement parking when an existing garage is converted to an ADU or JADU. The existing garage footprint and setbacks are preserved for the conversion, even where they would not meet today's 3- to 4-foot minimums. A JADU created in an attached garage is capped at 500 sq ft and must be within the walls of the primary single-family dwelling β owner-occupancy of the main house or the JADU is required by state law and recorded by deed restriction for JADUs only. Conversions require a building permit from San Jose Development Services and must meet California Residential Code requirements for habitable space β ceiling height, egress, light and ventilation, smoke and CO alarms, and fire separation. Rentals must be for terms longer than 30 days.
Converting a garage to habitable space without a building permit is a code violation under San Jose Building Code, subject to stop-work orders, fines, and potential requirement to permit the work or restore the garage. Using a converted-garage ADU for stays under 30 days violates SJMC 20.30.150 and the city's STR rules.
