Palo Alto allows conversion of an existing garage or accessory structure to an ADU or JADU under PAMC Β§18.42.040 and California Government Code Β§65852.2. No replacement parking is required. A converted accessory structure may expand by up to 150 sq ft to accommodate ingress and egress.
Under PAMC Β§18.42.040, an ADU proposed within an existing accessory structure (including a detached garage) may include an expansion of not more than 150 sq ft beyond the existing physical dimensions solely to accommodate ingress and egress, with side and rear setbacks sufficient for fire safety. State ADU law preempts any Palo Alto requirement for replacement parking when an existing garage is converted to an ADU. A JADU created within an attached garage of the single-family dwelling is capped at 500 sq ft and must be within the walls of the primary home, with owner-occupancy required and recorded by deed restriction. All conversions require a building permit from Palo Alto Development Services and must meet California Residential Code requirements for habitable space β egress, ceiling height, light and ventilation, smoke and CO alarms, and fire separation.
Converting a garage to habitable space without a building permit is a violation of Palo Alto Building Code and PAMC Β§18.42.040, subject to stop-work orders, fines, and required compliance. Using a converted garage as a short-term rental violates the recorded deed restriction.
