Summary

Whatcom County lets an accessory dwelling unit go on most residential and rural lots under WCC § 20.80.910, but the rules split sharply by location: one ADU per lot outside urban growth areas with owner-occupancy and multi-acre lot minimums for a detached unit, versus up to two ADUs with no minimum lot size once the parcel sits inside a designated urban growth area.

Full Breakdown

058). Outside designated urban growth areas, and inside the Lake Whatcom Watershed Overlay, General Commercial, Agriculture, Rural and Rural Forestry districts, a lot may carry only one ADU in addition to the primary dwelling, and the owner must occupy one of the two units as a primary domicile. Attached ADUs in most of those districts carry no minimum lot size, but a detached ADU needs four and one-half acres unless the parcel is large enough for two units at the district's gross density; the Agriculture District raises that to 40 acres, the Rural Forestry District to 20 acres, and the Lake Whatcom Watershed Overlay District to 10 acres (40 if the underlying zoning is Rural Forestry).

Inside designated urban growth areas the rules loosen: a lot may carry up to two ADUs beyond the primary dwelling, with no minimum lot size for either attached or detached units, and an existing detached structure such as a garage or barn can convert to an ADU even if it does not meet current setback or lot coverage standards. 91 WCC. Before a building permit issues, the owner must record a deed restriction with the Whatcom County auditor barring the detached ADU from being sold or financed separately from the main house, except where the zoning district allows a land division.

Violations & Fines

An accessory dwelling unit built without meeting these standards, or a detached unit sold separately from the main house in violation of the recorded deed restriction, is a zoning code violation Whatcom County Planning and Development Services can enforce by requiring the owner to bring the unit into compliance or remove it; because the deed restriction runs with the land, a buyer inherits the same restriction and the same exposure.
