Summary

Jefferson Parish's mixed-use use matrix (Table 33-3.50-1 in UDC § 33-3.50) lists the secondary or accessory dwelling unit under LBCS code 1121 and prohibits it in six of the eight districts: OBM-1, OBM-2, TCMU, FC-1, FC-2 and FC-3. It is allowed by right, marked P, only in the Unrestricted Suburban (U-1S) and Unrestricted Rural (U-1R) districts, and U-1S adds its own special permitted use triggers.

These county ordinances apply to unincorporated areas of Jefferson Parish. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Table 33-3.50-1, Authorized Land Uses for Mixed-Use Base Zoning Districts, lists the principal uses, as described in section 33-3.4.4 , master Use Matrix, permitted by-right (P), permitted with supplemental use regulations (S), permitted with approval of a special permitted use (SPU), or prohibited (X) within the mixed-use base zoning districts, in accordance with the interpretation provided in section 33-3.4.2 , interpretation of zoning district use matrices. ... Full Breakdown

The matrix row for a secondary or accessory dwelling unit (LBCS function code 1121, printed under Two family detached) reads X, X, X, X, X, X, P, P across eight columns, in this order: OBM-1 (Old Bucktown Mixed-Use Residential, § 33-3.51), OBM-2 (Old Bucktown Mixed-Use Commercial, § 33-3.52), TCMU (Town Center Mixed Use, § 33-3.54), FC-1, FC-2 and FC-3 (the three Fat City districts, § 33-3.53), U-1S (Unrestricted Suburban, § 33-3.58) and U-1R (Unrestricted Rural, § 33-3.59). The specific use standard column is blank for this row, so the table points to no separate Article 5 standard for it.

Section 33-3.4.2 supplies the legend. A P means allowed by right. An X means the use is not allowed unless otherwise expressly allowed within the UDC. Where a district permits mixed-use buildings, an X on private dwellings (function code 1100) refers to stand-alone single-use dwellings, and the number of dwelling units inside a mixed-use building is set by § 33-5.20.

A P in U-1S is not always final. Section 33-3.58.3(a)(2) treats a P as a special permitted use for single-, two-, three- and four-family developments exceeding 10 lots or 2 acres, for any addition that pushes a site past those thresholds, and for residential uses within 3,000 feet of the NOLA Motorsports main track. Short-term rentals are also a special permitted use there. That approval is an ordinance of the Parish Council under § 33-2.23, requested by the owner through the planning department with a site plan, and only one special permitted use is allowed per dwelling or lot. U-1S waives the two-year renewal requirement.

U-1R covers lands where natural topography restricts development. Uses on the unprotected side of the Pontchartrain and Vicinity, West Bank and Vicinity, or Mississippi River and Tributaries levees, or the Urban Growth Limit Line, need a PIER certificate under § 39-10. Accessory buildings and uses customarily incidental to permitted uses are allowed by § 33-3.59.2(b). The 1-4 family yard standards are a front and corner side yard of 20 feet (or the average front setback of neighboring buildings within 300 feet, no less than 10 feet), side yards totaling 20 percent of lot width, and a rear yard of 20 percent of lot depth held between 15 and 25 feet. Building height is capped at the width of the fronting right-of-way, 60 feet at most.

Violations & Fines

Section 33-1.13 makes any use maintained in violation of the UDC prohibited and punishable, with civil and criminal remedies that stack. The parish sends written notice and gives 10 days to abate, then can issue a citation. Each uncorrected day counts as a separate violation starting 10 days after notice, and a repeat violation can be cited with no new notice. The parish can also withhold or revoke permits, stop work, or seek an injunction or abatement in court.

Frequently Asked Questions

Can I build an accessory dwelling unit in a Fat City district?
No. The row for the secondary or accessory dwelling unit shows X under FC-1, FC-2 and FC-3, all governed by § 33-3.53. Under § 33-3.4.2(d) an X means the use is not allowed unless the UDC expressly allows it elsewhere. The table lists no specific use standard for this row, so it offers no conditional path.
Where in the mixed-use districts is an accessory dwelling unit allowed by right?
Only in the Unrestricted Suburban (U-1S, § 33-3.58) and Unrestricted Rural (U-1R, § 33-3.59) districts, where the row shows P. In U-1S that P can become a special permitted use if the site is part of a family-housing development over 10 lots or 2 acres, or sits within 3,000 feet of the NOLA Motorsports main track.
What does a special permitted use require in U-1S?
The owner files an application with the planning department that includes a site plan, and the Jefferson Parish Council decides it by ordinance under § 33-2.23. No more than one special permitted use is allowed per dwelling or lot, and none on premises with a home occupation. The usual two-year renewal does not apply in U-1S.
What happens if an accessory dwelling unit is built where the matrix prohibits it?
Section 33-1.13 treats it as a violation. The parish sends written notice and expects abatement within 10 days, then can cite the owner, with each further uncorrected day counted as a separate violation. It can also withhold or revoke permits, stop work, or go to district court for an injunction or abatement.
