Full Breakdown

07 of the Comprehensive Land Development Resolution, the county's zoning code (not the general municipal code), accessory buildings in residential and agricultural districts are split into attached and detached categories. An accessory building attached to the main dwelling by a roof and sharing a substantial part of a wall must meet every requirement that applies to the main building itself, including full setbacks and height limits for that zoning district. A detached shed, garage, or similar structure gets more flexibility: it must stay at least 10 feet from the main dwelling and at least 5 feet from any interior lot line or alley, and it must still meet the main dwelling's setback from the street right-of-way, with a flat rule that it can never sit in the front yard regardless of that setback math.

Height and coverage are capped separately: a detached accessory building cannot exceed two stories and cannot cover more than 30 percent of the side or rear yard it sits in. 06[2] and that district's own yard requirements. Temporary buildings tied to active construction are allowed but must be removed immediately once construction wraps up, and a certificate of zoning compliance is required to use one. The code separately bars manufactured homes, mobile homes, freight trailers, box cars, and any other structure or vehicle not originally built to serve as an accessory building. 03. Violations of these zoning standards are enforced under Chapter 33 of the same Resolution.

Violations & Fines

A violation of Section 4.07 is a misdemeanor under Section 33.01 of the Comprehensive Land Development Resolution, with each day of noncompliance counted as a separate offense. The zoning enforcement officer can also issue a cease-and-desist order under Section 33.04, giving the owner up to 30 days to bring the structure into compliance before further enforcement.
