Montgomery County Department of Permitting Services (DPS) exempts detached accessory structures (sheds, tool houses, playhouses) from building permits if they are 200 square feet or less in floor area, one story, and do not contain plumbing, electrical, or mechanical systems. Sheds exceeding 200 square feet require a residential building permit and must comply with the International Residential Code (IRC) for structural, wind, and snow load requirements. Regardless of size, all sheds must comply with Montgomery County Zoning Ordinance Section 59.3.6 for accessory structures, including setback requirements. In most residential zones, accessory structures must be at least 5 feet from side and rear property lines. Sheds must be located in the side or rear yard; placement in the front yard is generally prohibited. Maximum lot coverage (including all structures) must not be exceeded. The height of accessory structures is typically limited to 15 feet in most residential zones unless the structure qualifies as an ADU or other special use. Sheds must not be used for habitation or commercial purposes. Prefabricated and kit sheds must still comply with setback and lot coverage rules even if permit-exempt.
Sheds built without required permits or in violation of setbacks may trigger DPS enforcement. The county may require removal or relocation of non-compliant structures. Fines apply for unpermitted construction over 200 square feet.
