The Lake County UDO does not define tiny homes, but section 154-9-030 defines a backyard cottage as 'a small accessory building occupied by a single, self-contained accessory dwelling unit' on the same lot as a detached house. That is the pathway for a permanently sited tiny house: approved as a special exception in A-1 and R districts, in the rear yard set back 10 ft from side/rear lines, no more than 24 ft tall, floor area capped at 49% of the home or 580 sq ft. Only one per lot, not on two-unit or multi-unit lots. It must meet building and fire codes; lots without central sewer need Health Department approval. Tiny homes on wheels (RVs) are not permitted dwellings.
Placing a tiny-home dwelling without the special exception is a zoning violation: 15-day cure notice, then citations up to $2,500 (first) and $7,500 (subsequent) under IC 36-1-3-8, each day separate.
