FL Β§586.10 preempts local governments from banning beekeeping. Cities cannot prohibit beekeeping. FDACS (FL Dept. of Agriculture) regulates. Annual hive registration required with FDACS. HOAs may still impose restrictions.
Florida Statute Chapter 586 (the Florida Honey Certification and Honeybee Law) requires all beekeepers to register their colonies annually with FDACS. Registration fees range from $10 for hobbyists (up to 5 hives) to $100 for commercial operators (100+ hives). Beekeepers receive a unique firm number that must be permanently marked on each hive body. Annual inspections for American Foulbrood are conducted by FDACS apiary inspectors. Critically, state law preempts local ordinances regarding placement and location of registered, inspected managed honeybee colonies, meaning Hollywood cannot ban beekeeping outright. However, HOA restrictions remain enforceable. Colonies on residential (non-agricultural) land require written FDACS permission and compliance with the Beekeeper Compliance Agreement Best Management Requirements. Contact your local FDACS apiary inspector to schedule an initial assessment before starting hives.
Unregistered colonies: FDACS enforcement. Diseased or Africanized colonies may be destroyed. HOA violations handled through HOA processes, not city enforcement.
