Summary

Elkhart County parks are a no-hunting zone for wild birds and other feral animals. Section 93.018 makes it unlawful to kill, wound, trap, shoot at, chase or even possess a feral bird, mammal, reptile or amphibian taken from a county park, with narrow fishing and permitted-management exceptions.

These county ordinances apply to unincorporated areas of Elkhart County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

§ 93.018 INFLICTING INJURY TO WILDLIFE PROHIBITED. Except as hereinafter provided, it shall be unlawful for any person within a park to kill, wound, hunt, trap, shoot, throw rocks or missiles at, chase, molest or remove any feral mammal, reptile, amphibian or bird, or knowingly to buy, receive, have in his or her possession, sell or give away any such mammal, reptile, amphibian, bird or egg so killed or taken within any park.

Full Breakdown

Section 93.018 of the Park Rules, adopted with Ord. 12-177 on April 16, 2012, states: 'it shall be unlawful for any person within a park to kill, wound, hunt, trap, shoot, throw rocks or missiles at, chase, molest or remove any feral mammal, reptile, amphibian or bird, or knowingly to buy, receive, have in his or her possession, sell or give away any such mammal, reptile, amphibian, bird or egg so killed or taken within any park.' The prohibition covers birds specifically among the protected classes, along with their eggs, and reaches not just the act of killing but buying, selling or possessing an animal or egg taken unlawfully from a park.

Two narrow exceptions apply. The ordinance does not stop a person from fishing for personal use by continuously attended and monitored methods, and it does not stop hunting or trapping of certain species as a wildlife management tool if the Director of the Park Department or the Park Board has issued a specific permit for it. Outside those two carve-outs, there is no general hunting season or nuisance-wildlife exception inside county park boundaries.

Violations & Fines

Killing, trapping, shooting at or possessing an unlawfully taken bird, mammal, reptile, amphibian or egg inside a county park violates § 93.018 and is punishable by a fine of up to $1,000 under § 93.999(A)(1). Park rangers deputized by the Park Board issue the citations.

Frequently Asked Questions

Can I fish in an Elkhart County park lake?
Yes. Section 93.018 specifically allows harvesting fish for personal use as long as you use continuously attended and monitored fishing methods; the wildlife-injury ban targets mammals, reptiles, amphibians and birds, not fish.
Is it illegal to throw rocks at geese in a county park?
Yes. Section 93.018 bans throwing rocks or missiles at, chasing or molesting any feral bird within a park, in addition to killing, trapping or shooting at it.
Can the county ever authorize trapping nuisance wildlife in a park?
Only with a specific permit. Section 93.018 exempts hunting or trapping done as a wildlife management tool under restricted conditions and a permit issued by the Park Department Director or the Park Board.
