Topeka, KS Animal Ordinances: Bird Protection (2026)

TMC 6.30.030 makes it unlawful to knowingly shoot, kill, maim, or injure any bird or fowl of the air in Topeka, or to destroy its nest. Two exceptions apply: English sparrows and starlings (or their nests) may be destroyed at any time without firearms, and pigeons or other birds that become a public nuisance by nesting or roosting on private property may be destroyed by an approved pest control firm after a complaint to Animal Control and any required state or local permit. A related section, TMC 6.05.110, separately bans injuring or killing wild/undomesticated animals generally, with limited licensed hunting exceptions for deer, turkey, and migratory game birds on KDWPT land.
