The rule sits in Article II (Noise) of Chapter 9.45, Offenses against Public Peace and Order, in Title 9 of the Topeka Municipal Code, and it applies inside the City of Topeka limits in Shawnee County, Kansas. Section 9.45.310 is titled Blowers and internal combustion engines. It is a single sentence with two targets. The first is any "noise-creating blower or power fan." The second is any internal combustion engine whose operation "causes noise due to the explosion of operating gases or fluids." The clause about muffling closes the sentence: operation is unlawful "unless the noise from such blower or fan is muffled."

Three things the text does not do matter to a homeowner or a lawn crew. It does not print a start or end hour for blowers. It does not set a decibel or distance limit. It does not use the words leaf blower, gas blower, or electric blower, so the test is the sentence itself: is the machine a blower or power fan that creates noise, and is that noise muffled? The two other equipment sections in the same article use clock hours, but only for their own subjects.
