Wilmington, DE Animal Ordinances: Bird Protection (2026)

City Code Chapter 3, Article II protects baby fowl and young rabbits from impulse-sale and novelty abuse. Section 3-46 bars selling, bartering or giving away living baby chicks, ducklings or other fowl, or rabbits under two months old, in any quantity less than six. Section 3-47 bans selling, displaying or giving away any of these animals after they've been dyed or artificially colored. Section 3-48 prohibits using a newly hatched bird, fowl or newly born rabbit as a toy, for display, or subjecting it to careless handling. Licensed hatcheries and stores selling from proper brooder facilities are exempt under Section 3-49.
