Texas Health & Safety Code Sec. 822.047 expressly preempts any city or county ordinance that regulates a dog based solely on its breed. That means Allen cannot ban pit bulls, Rottweilers, or any other breed β only individual behavior can trigger regulation. Dangerous dog determinations follow TX Health & Safety Code Chapter 822 Subchapter D (Lillian's Law, enacted 2007 after the 2005 Lillian Stiles case in Milam County). A dog declared dangerous in Allen must be registered with Allen Animal Services, kept in a secure enclosure, leashed and muzzled in public, and covered by $100,000 liability insurance or equivalent surety bond.
