There is no pit-bull or breed ban in Galveston County, and there legally cannot be one. Health & Safety Code 822.047 lets a county or municipality add dangerous-dog requirements only if they are not specific to one breed or several breeds. Instead, Texas regulates dogs by conduct: a 'dangerous dog' is one that makes an unprovoked attack causing bodily injury outside a secure enclosure, or acts that make a person reasonably believe it will attack (822.041). Once a dog is declared dangerous, the owner must register it, keep it leashed or enclosed, and carry $100,000 liability coverage (822.042). Cities such as Galveston and League City follow the same behavior-based framework.
A city cannot enforce a breed ban. An owner of a declared dangerous dog who fails to comply faces seizure; an unprovoked attack causing serious bodily injury is a third-degree felony (822.005).
