Cedar Park has no breed-specific ban or restriction — Texas Health & Safety Code §822.047 preempts cities and counties from regulating dogs by breed. The city regulates dangerous dogs by behavior under Article 2.09 instead.
Texas Health & Safety Code §822.047 expressly forbids a county or municipality from placing additional dangerous-dog requirements or restrictions that are 'specific to one breed or several breeds of dogs.' Cedar Park's Chapter 2, Article 2.09 (Dangerous Dogs and Cats) accordingly classifies dogs based on behavior — an unprovoked attack causing bodily injury outside a secure enclosure, or unprovoked acts causing reasonable fear of attack — not on appearance or breed. Cedar Park has elected to be governed by Tex. HSC §822.0422, which lets citizens file dangerous-dog complaints in Municipal Court. Owners of dogs declared dangerous must register the animal with the city, restrain it on a leash in immediate control or inside a secure enclosure at all times, and otherwise comply with §822.042 obligations (liability insurance, secure enclosure, signage). Texas HB 4759 (88th Legislature, 2023) further reinforced behavior-based regulation. No pit-bull, Rottweiler, or other breed ban exists locally and none may be lawfully adopted.
There is no breed-ban violation. Failure to comply with dangerous-dog requirements under Article 2.09 (after a dog is judicially declared dangerous) is a Class C misdemeanor under city code and a Class C misdemeanor under Tex. HSC §822.044, escalating to Class A misdemeanor or felony if a dangerous dog causes serious bodily injury or death. Animal Control may seek a destruction order through Municipal Court under §822.0422 procedures.
