Summary
Spotsylvania County has no breed ban. A dog can only be declared dangerous after a court hearing based on what it actually did, such as seriously injuring a person or another companion animal, never solely because of its breed.
Any law enforcement officer or animal control officer who (i) has reason to believe that an animal is a dangerous dog and (ii) the animal resides in, or act is committed in the County may apply to a magistrate for the issuance of a summons requiring the owner, if known, to appear before the general district court at a specified time. ... The court shall determine that the animal is a dangerous dog if the evidence shows that it (i) killed a companion animal that is a dog or cat or inflicted serious injury on a companion animal that is a dog or cat ... or (ii) directly caused serious injury to a person, including laceration, broken bone, or substantial puncture of skin by teeth. ... No animal shall be found by the court to be a dangerous dog: 1.Solely because it is a particular breed
Full Breakdown
Sec. 4-31 sets out how the county handles a dog accused of being dangerous. A law enforcement or animal control officer who believes a dog is dangerous applies to a magistrate for a summons requiring the owner to appear before the general district court, and the officer must skip that step if the injury to a companion animal was not serious, both animals share an owner, the incident happened on the biting dog's own property, or a human injury was only a minor scratch or abrasion.
2's misdemeanor procedure. The court can only find a dog dangerous if it killed or seriously injured a companion animal that is a dog or cat, or directly caused a serious injury to a person such as a laceration, broken bone, or substantial puncture from teeth. Sec. 4-31(K) then lists the defenses that block a dangerous-dog finding altogether: the dog cannot be found dangerous solely because of its breed, if the victim was committing a crime or trespass on the owner's premises, if the victim had provoked or abused the dog, if the dog is an on-duty police dog, if the dog was responding to its own pain or protecting itself, its offspring, a person, or property, or if it was hunting or in an organized dog-handling event.
Once declared dangerous, Sec. 4-32 requires the owner to obtain neutering or spaying documentation, microchip the dog, carry at least $100,000 in liability coverage or a bond, pay the county a $150 fee, complete a state dangerous-dog registration certificate, and post warning signs at every entrance to the home and yard.
Violations & Fines
Owners who willfully fail to comply with the dangerous-dog requirements of Sections 4-31 through 4-33 or 4-35 are guilty of a Class 1 misdemeanor under Sec. 4-34, and the court can order the dog disposed of under Virginia Code Section 3.2-6562 or give the owner up to 30 days to come into compliance. A subsequent attack by a dog already found dangerous is a Class 2 misdemeanor if it injures or kills another companion animal, or a Class 1 misdemeanor if it bites or injures a person, under Sec. 4-35.
