Neither McHenry County nor Illinois bans dogs by breed. Under 510 ILCS 5/15, a dog is regulated by its individual conduct — vicious dogs must be confined to an enclosure and, when out, muzzled and restrained by a 300-pound chain. The statute forbids breed-specific classification.
Illinois' Animal Control Act (510 ILCS 5/15) defines a "vicious dog" as a dog that, unprovoked, bites or attacks a person or animal, or has a known propensity to attack. A vicious dog must at all times be kept in an enclosure; it may leave only for veterinary care or court order while securely muzzled and restrained by a chain of at least 300-pound tensile strength no longer than three feet. Critically, the Act states vicious dogs shall not be classified by breed. McHenry County's ordinance (§ 8.04.860) defines a vicious dog as one that without justification attacks a person causing serious injury or death, or is found a "dangerous dog" three separate times.
Keeping a declared vicious dog outside an approved enclosure leads to impoundment and possible court-ordered euthanasia; owners face fines and mandatory spay/neuter and microchipping.
