Walnut Creek cannot ban or restrict any dog based on breed. California Food & Agricultural Code Section 31683 explicitly preempts all local breed-specific legislation, meaning pit bulls, Rottweilers, German Shepherds, and all other breeds are treated equally under the law. Dangerous dog determinations are behavior-based and are processed through Contra Costa County Animal Services under California Food & Agricultural Code Sections 31601-31683. A dog may be declared 'potentially dangerous' after two unprovoked aggressive incidents within 36 months, or 'vicious' after a severe attack causing injury.
