These county ordinances apply to unincorporated areas of Jessamine County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(A) An owner of a canine shall be responsible for restricting that canine to the property of the owner 24 hours a day. Restricting a canine to the property of the owner may be accomplished by way of leash, chain, leash and running wire, fence (electrified or non-electrified), or any other means, provided the means of restraint are calculated to restrict the canine to the property of the owner in a reasonable and humane manner; and meeting the requirements set forth in § 90.08(F). (B) Any canine found upon public or private property outside the premises of its owner that is not restrained or under its owner’s control shall be presumed to be running at large and in violation of this chapter. (C) Any canine found upon public or private property outside the premises of its owner that is not restrained or under its owner’s control may be impounded by an Animal Control Officer, as stipulated in KRS 258.215(1).

Full Breakdown

Section 90.03 of the Jessamine County Code, adopted by the Fiscal Court in the animal control chapter, puts the burden on the owner. Under subsection (A), the owner of a canine is responsible for restricting that canine to the owner's property 24 hours a day. The code lists the acceptable means: leash, chain, leash and running wire, fence (electrified or non-electrified), or any other means, as long as the means are calculated to restrict the canine in a reasonable and humane manner. A tethered dog must also meet § 90.08(F), which requires no less than ten feet of chain or cable with a swivel, a fixed immobile anchor point, and a nylon or leather collar rather than a training collar.

Subsection (B) sets the presumption: any canine found on public or private property outside its owner's premises that is not restrained or under its owner's control is presumed to be running at large and in violation of the chapter. Subsection (C) lets an Animal Control Officer impound the dog as stipulated in KRS 258.215(1). Under subsection (D), an impounded dog is held at the animal shelter for five days. After that the dog becomes the property of the Jessamine County Fiscal Court and is offered for adoption or can be euthanized at the discretion of the Director of Animal Care and Control.

Getting the dog back has its own steps. Section 90.02(D) requires the owner to pay a return to owner fee set by the Fiscal Court and to show proof of a Jessamine County Canine License before release, and every canine is injected with a microchip before it leaves the shelter. Section 90.06 makes the owner liable under the chapter for damages caused when a canine not under control leaves the property.

Two exceptions appear in subsection (E). The chapter does not apply to a hound or hunting canine released from confinement for hunting, as stipulated in KRS 258.215(2), and a canine left unattended in a motor vehicle is deemed compliant while it stays in the vehicle and the owner meets the stipulations of § 90.08(G). Section 90.08(O) adds a separate bar on letting a canine, on or off leash, intimidate, harass or worry another canine on its own owner's property.

Violations & Fines

Section 90.99(A) sets the fine on conviction. A first offense draws no less than $50 and no more than $100, a second offense no less than $100 and no more than $150, and a third or later offense no less than $150 and no more than $200, each in addition to any costs assessed by the District Court. The shelter charges the return to owner fee and licensing fees on release.

Frequently Asked Questions

Does my dog have to be on a leash in my own yard?
Not necessarily on a leash. Section 90.03(A) accepts a leash, chain, leash and running wire, fence (electrified or non-electrified), or any other means calculated to keep the canine on your property in a reasonable and humane manner. The duty runs 24 hours a day, and a tether must also meet § 90.08(F).
What happens if Animal Control picks up my loose dog?
The dog is impounded at the animal shelter and held for five days. To reclaim it you pay the return to owner fee set by the Fiscal Court, show proof of a Jessamine County Canine License or pay the licensing fees, and the dog is microchipped before release. After five days the dog becomes county property.
How much is the fine for a dog running at large?
Section 90.99(A) sets a first-offense fine of no less than $50 and no more than $100. A second offense runs $100 to $150 and a third or later offense $150 to $200, always plus any costs assessed by the District Court. The owner is the person fined.
Are hunting dogs exempt?
A hound or hunting canine released from confinement for the purpose of hunting is outside the chapter under § 90.03(E), as stipulated in KRS 258.215(2). The definition of stray adds that a hunting dog temporarily lost from its pack, or wandered from sight of its handler, does not put the owner in violation.
Can I leave my dog in the car instead of restraining it?
A canine left unattended in a motor vehicle by its owner is deemed in compliance with the chapter for as long as it remains in the vehicle and the owner follows the stipulations of § 90.08(G). That section bars keeping a dog in a car without adequate ventilation in summer or warmth in winter.
