Summary

Porter County bans pet shops from selling or offering for sale any dog, cat or rabbit under Code Sec. 12-282, adopted July 24, 2023. A pet shop may host animals for adoption only if a genuine nonprofit rescue organization runs the adoption, with no fee flowing to the store and no ownership interest in the animals held by the shop.

These county ordinances apply to unincorporated areas of Porter County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(a)Retail sale of dogs, cats or rabbits by pet shops prohibited.(1)It shall be unlawful for a pet shop to sell or offer for sale a dog, cat, or rabbit.(2)A pet shop may provide space for the display of dogs, cats, or rabbits that are available for adoption only if such animals are displayed and made available for adoption by an animal rescue organization and all of the following conditions are met: No part of any fees associated with the display or adoption of the animals, including but not limited to adoption fees or fees for the provision of space, shall be paid to the host pet shop or to any entity affiliated with or under common ownership with the host pet shop; and The host pet shop shall not have any ownership, interest in any of the animals displayed for adoption. (b)(2)A pet shop that sells or offers for sale a dog, cat, or rabbit in violation of this chapter is subject to admission of the violation and payment of a civil penalty in an amount on $500.00 for the pet shop's first violation.

Full Breakdown

Article XIII of Chapter 12, added by Ord. No. 23-14 on July 24, 2023, prohibits any pet shop in unincorporated Porter County from selling or offering for sale a dog, cat or rabbit. Sec. 12-281 defines the covered terms narrowly: an 'animal rescue organization' must be a 501(c)(3) nonprofit whose mission is rescuing and placing animals, and it cannot share ownership, premises or personnel with a commercial breeder or buy animals from one. A 'pet shop' covers any facility operated commercially and principally to sell pets, or any retail store where animals are kept, sold or offered for sale, but the definition excludes a genuine animal rescue organization.

Sec. 12-282(a) creates the sale ban, but carves out a narrow adoption channel: a pet shop may display dogs, cats or rabbits for adoption if a qualifying rescue organization runs the adoption, none of the adoption or space fees go to the host pet shop or an affiliated entity, and the pet shop holds no ownership interest in the animals. Porter County Code Enforcement is the enforcing agency under subsection (b). 00 civil penalty, with each unlawful sale or offer counted as a separate offense.

The 'kennel' definition in Sec. 12-281 exempts hobby breeders operating from a private residence and the occasional sale of their puppies or kittens, so the ordinance targets commercial retail pet shops rather than individual hobby breeders.

Violations & Fines

Porter County Code Enforcement can cite a pet shop that sells or offers to sell a dog, cat or rabbit under Sec. 12-282(b). The first violation is a $500.00 civil penalty; the second violation and every one after it is a $1,000.00 civil penalty. Each individual unlawful sale or offer for sale is treated as its own separate offense, so a shop that sells multiple animals can face multiple penalties from a single inspection.

Frequently Asked Questions

Can a pet store in Porter County sell puppies or kittens?
No. Sec. 12-282 makes it unlawful for a pet shop to sell or offer for sale a dog, cat or rabbit anywhere in unincorporated Porter County. The only lawful path for a pet shop to host these animals is hosting a qualifying nonprofit rescue's adoption event with no fees paid to the store.
Does the Porter County pet shop ban affect home breeders?
No. Sec. 12-281 defines 'kennel' to exclude a private residence where dogs are kept for hobby purposes such as hunting or showing, and it specifically allows the occasional sale of puppies or kittens by that householder without becoming a regulated kennel or pet shop.
What is the fine for a Porter County pet shop that sells a banned animal?
Porter County Code Enforcement can assess a $500.00 civil penalty for a pet shop's first violation of Sec. 12-282 and a $1,000.00 civil penalty for its second and any later violation, with each individual sale or offer counted separately.
