Virginia state law prohibits feeding bears year-round and deer from September 1 through the first Saturday in January under Virginia Code Β§29.1-521.2 and DWR regulation 4VAC15-40-285. Virginia Beach also discourages feeding of other wildlife including raccoons, foxes, and feral cats that can become public nuisances. Feeding waterfowl at city parks and beaches is generally discouraged and may be prohibited at specific sites. Violations of state wildlife feeding laws are Class 3 misdemeanors with fines up to $500. Bird feeders for songbirds are permitted but should be managed to avoid attracting bears.
Wildlife feeding is regulated by both Virginia state law and Virginia Beach city practice. Under Virginia Code Β§29.1-521.2 and Virginia Department of Wildlife Resources (DWR) regulation 4VAC15-40-285, it is illegal year-round to feed black bears anywhere in Virginia. This includes intentional feeding (putting out food, corn, grain) and effectively unintentional feeding after warning (leaving unsecured garbage, pet food, bird seed that attracts bears). Violations are Class 3 misdemeanors with fines up to $500. Deer feeding is prohibited from September 1 through the first Saturday in January under the same regulation, covering hunting seasons to prevent baiting; unlawful feeding during this window is also a misdemeanor. DWR can order cessation of feeding any wildlife that creates a public safety hazard or disease transmission risk. Chronic Wasting Disease (CWD) response has expanded restrictions in some areas. Virginia Beach, though primarily suburban/urban, does have black bear sightings (especially in Pungo and wooded areas) and white-tailed deer throughout the city. City practices and the Parks and Recreation Department discourage feeding of waterfowl at parks and on the oceanfront β feeding ducks, gulls, and geese bread causes malnutrition, water pollution, and aggressive bird behavior. Feeding feral cats is regulated under city animal code; managed Trap-Neuter-Return (TNR) colonies by registered caretakers are generally accepted, but casual feeding that creates nuisance conditions can trigger enforcement. Raccoons, foxes, coyotes, and opossums should not be fed β feeding habituates wildlife, increases disease transmission risk (rabies is endemic in Virginia raccoons), and creates property damage. Bird feeders for songbirds are not prohibited but should be: taken down if bears are reported in the area; cleaned regularly to prevent disease outbreaks; positioned to minimize rodent attraction. Garbage must be secured in bear-resistant containers in bear-active areas. Violations are enforced by DWR Conservation Police (1-800-237-5712) and Virginia Beach Animal Control at (757) 385-4444.
Specific penalty amounts for this ordinance are not published in a publicly accessible fine schedule. Contact Virginia Beach code enforcement directly for current fines, enforcement procedures, and hearing options.
