Sarasota's Food Trucks & Mobile Vendors: The Rules That Matter
Every city handles food trucks & mobile vendors a little differently. In Sarasota, Florida, there are 3 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.
Vending Zones
Mobile food trucks may only operate in zone districts that list the use as permitted under Article VI of the City of Sarasota Zoning Code, and only with the property owner's written approval on file with the city. Operating hours run 6:00 a.m. to 11:00 p.m. Sunday through Thursday and 6:00 a.m. to 2:00 a.m. Friday and Saturday.
Key details: Hours Sun-Thu: 6:00 a.m. to 11:00 p.m.. Hours Fri-Sat: 6:00 a.m. to 2:00 a.m.. Max trucks per property: 3, more allowed on G-zoned city land. Restroom rule: Required documentation past 3 hours on site. Right-of-way vending: Prohibited.
The zoning code's enforcement runs through the city's standard code enforcement process for zoning violations: a truck operating without the required permitted-district location, owner's written permission, business tax receipt, or within a banned overnight-parking zone is subject to a notice of violation, an opportunity to correct, and referral to the city's special magistrate for fines if uncorrected. Alcohol sales outside a special event or temporary commercial activity permit can also trigger separate state ABT licensing exposure.
Sidewalk & Mobile Vending
The City of Sarasota requires a city manager-issued commercial vending permit for stationary or mobile vending on public property and rights-of-way, with a $150 fee and mandatory liability insurance.
Key details: Application fee: $150. Permit term: Expires every October 1. Liability insurance: $1M/$2M required. Max penalty: $500 fine or 60 days jail. Permitting authority: City Manager.
Vending without a permit, or violating permit conditions, triggers written notice and permit revocation; the ordinance also carries a fine up to $500 or up to 60 days' imprisonment, each day a separate offense.
Food Truck Permits
City of Sarasota requires every mobile food truck to carry a business tax receipt, use a purpose-built and properly licensed vehicle, and hold minimum liability insurance.
Key details: Business tax receipt: Required, state and local. Vehicle: Must be purpose-built and licensed. Insurance: Minimum required by law.
Operating without a current business tax receipt, using a vehicle not built or licensed for mobile vending, or vending without the required insurance violates Sec. VII-602(ii)(2)-(4) and can lead to citation or an order to cease operating.
This is one of the stricter rules in Sarasota's municipal code. If you are unsure whether your situation complies, it is worth checking with the city before proceeding.
The Bottom Line
Sarasota's food trucks & mobile vendors rules are a mixed bag. Some areas are strict, others are relaxed, and the details matter. The best approach is to check the specific rule that applies to your situation rather than assuming Sarasota is broadly strict or permissive.
Keep in mind that Sarasota can amend these rules at any council meeting. For the most current version of any rule mentioned here, check the specific ordinance page, where we track updates as they happen.
