Modesto's Parking Rules: The Rules That Matter
Every city handles parking rules a little differently. In Modesto, California, there are 5 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.
RV & Boat Parking
Modesto zoning section 10-3.214 limits a residential lot to two recreational vehicles parked outside a structure, requires they sit at least 3 feet from any habitable building and outside the clear-vision zone, and prohibits any portion of the RV from overhanging the public sidewalk.
Key details: Zoning Section: Modesto MC § 10-3.214. Max RVs on Residential Lot (outside): 2. Setback from Dwelling: 3 feet. Sidewalk Overhang: Prohibited. Trailer On-Street Fine: $137 (§ 3-2.2007).
Code Enforcement may cite zoning violations under Title 10 and abate them as nuisances under Title 9 (Property Maintenance Code). On-street violations of the 72-hour rule are $108 (sec. 3-2.1002); illegally parked trailers carry a $137 fine under sec. 3-2.2007 per the City's Parking Violation Fine Schedule. Report via 209-577-5250 or the Go Modesto App.
Driveway Rules
Modesto requires vehicles parked in driveways to be on improved surfaces and not block sidewalks or the public right-of-way. Front yard parking on unimproved surfaces (dirt, grass) is a common code violation.
Key details: Surface: Improved surface required. Lawn Parking: Prohibited. Sidewalk: Must not block. Inoperable Vehicles: Not permitted in view.
Parking on unimproved surface: code violation notice. Inoperable vehicle visible from street: abatement notice and potential towing.
Commercial Vehicle Restrictions
Modesto Municipal Code section 3-2.1006 prohibits parking commercial vehicles (generally over 10,000 lbs GVWR) in residential districts, with a $127 citation. Truck routes are separately enforced under section 3-2.1301 at $96. Parking a commercial vehicle in a metered downtown space carries a $71 fine under sec. 3-2.1511.
Key details: Code Section: Modesto MC § 3-2.1006. Citation: $127.00. Commercial Vehicle Threshold: Over 10,000 lbs GVWR. Truck Routes: $96 (§ 3-2.1301). Trailers (alone): $137 (§ 3-2.2007).
$127 citation under MMC sec. 3-2.1006 for parking a commercial vehicle in a residential district. $96 for off-route truck operation (sec. 3-2.1301). $71 for parking a commercial vehicle in a metered space (sec. 3-2.1511). $83 for oversized-vehicle parking (sec. 3-2.2006). $137 for parking a trailer separated from its tow vehicle (sec. 3-2.2007). Repeat or commercial-scale violations may also be abated as a nuisance.
This is not one of those rules that cities tend to ignore. Modesto actively enforces its commercial vehicle restrictions requirements.
Overnight Parking
Modesto has no blanket overnight parking ban. The default rule is the 72-hour storage limit (sec. 3-2.1002). Residential Parking Permit Zones under Article 19 of Title 3 restrict on-street parking to permit holders in designated neighborhoods, and living overnight in a vehicle on private property is barred by section 10-3.211 after 72 consecutive hours.
Key details: Citywide Overnight Ban: None - 72-hour rule applies. Permit Zones: Modesto MC Article 19 (§§ 3-2.1901-1910). No-Permit Citation: $61.00 (§ 3-2.1904(a)). Permit Misuse Fine: $500.00 (§ 3-2.1904(c)-(e)). Living in RV on Property: Unlawful after 72 hours (§ 10-3.211).
On-street: $108 for 72-hour storage (sec. 3-2.1002); $61 for no residential permit (sec. 3-2.1904(a)); up to $500 for permit misuse (sec. 3-2.1904(c)-(e)); $56-$61 for violating posted no-parking signs (sec. 3-2.1007, 3-2.1203). On private property: zoning enforcement under sec. 10-3.211 plus nuisance abatement under Title 9 if a vehicle is occupied as a dwelling beyond 72 hours.
