Sandy's Zoning Overlays & Bonuses: The Rules That Matter

By CityRuleLookup Editorial Team

Every city handles zoning overlays & bonuses a little differently. In Sandy, Utah, there are 2 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Density Bonus Law

In Sandy's SD Magna/2000 East Planned Unit Development Subdistrict, developers can raise density from a 15-unit-per-acre base up to 22 units per acre by providing amenities such as extra open space, recreation facilities, or covered parking, under Sandy City Code Section 21-19-6B.

Key details: Base density (west PUD): 15 dwelling units/gross acre. Max bonus density (west PUD): Up to 22 units/gross acre. Max density (east PUD): 6 dwelling units/gross acre. Largest single bonus: Up to 20% for enclosed parking. Approval authority: Sandy Planning Commission, site plan review.

Density bonuses under Section 21-19-6B are not self-executing: a developer cannot claim the higher unit count without site plan approval from the Sandy Planning Commission confirming the qualifying amenities are actually provided. Building beyond the 15-unit-per-acre base density without that confirmed approval exceeds the entitlement and exposes the project to code enforcement action and denial of building permits for the excess units until the amenity package is verified and approved.

Downtown Design Guide

Every building proposed in Sandy's Central Business District must clear a dedicated architectural review committee, which checks design, colors, and materials against the Sandy City Architectural Design Standards before the Planning Commission ever sees the application, under Sandy City Code Section 21-23-21.

Key details: Review body: Architectural review committee. Established by: Joint City Council/Mayor resolution. Reviews: Design, colors, materials. Order of review: Before Planning Commission submission. Governing section: Sandy City Code Β§ 21-23-21.

A building cannot advance to Planning Commission review, and therefore cannot obtain site plan or building permit approval, without first clearing the architectural review committee under Section 21-23-21. Constructing without the required approvals exposes a developer to a stop-work order and to Sandy's default code penalty in Sections 1-2-2 and 1-2-3: a Class B misdemeanor with fines up to $1,000 for an individual or $5,000 for a corporation.

This is not one of those rules that cities tend to ignore. Sandy actively enforces its downtown design guide requirements.

The Bottom Line

Sandy's zoning overlays & bonuses rules are a mixed bag. Some areas are strict, others are relaxed, and the details matter. The best approach is to check the specific rule that applies to your situation rather than assuming Sandy is broadly strict or permissive.
