Full Breakdown
Under City Code § 118-4, the Building Department must issue a permit before you construct, enlarge, alter, improve, remove, relocate, or demolish any building or structure, or install a solid-fuel-burning appliance, chimney, or flue in a dwelling unit. Applications need at least two sets of construction documents and, where the Education Law requires it, drawings stamped by a New York-registered architect or licensed engineer. Detached one-story sheds under 144 square feet, above-ground pools under 24 inches deep, and most fences are exempt. Permits expire if work does not start within 24 months of issuance.
Violations & Fines
Starting work without the required permit triggers a stop-work order under § 118-6, halting the job immediately. The city enforces unpermitted construction under § 118-15, where a first offense within a twelve-month period is charged as a violation carrying fines.
