Summary

St. Tammany Parish requires a permit from the director before anyone builds, enlarges, alters, moves, or demolishes a structure, or installs a regulated electrical, mechanical, plumbing, or gas system, under UDC Sec. 300-2(A). A short list of minor work is exempt, including small accessory sheds, finish work, and fences 7 feet or under, but everything else needs approval first.

These county ordinances apply to unincorporated areas of St. Tammany Parish. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

A.Required. Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert, or replace any electrical, mechanical, plumbing, or gas system, the installation of which is regulated by the UDC, or cause any such work to be done, shall first make application to the director and obtain the required permit.B.Work Exempt from Permit. Exemptions from permit requirements of the UDC shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of the UDC or any other laws or ordinances of this jurisdiction. Permits shall not be required for the following:1.Building.a.One story detached accessory structures, accessory to single- and two-family dwellings, used as tool, storage sheds, playhouses, and similar uses provided the floor area does not exceed 200 square feet. [...] g.Water tanks supported directly upon grade if the capacity does not exceed 5,000 gallons and the ratio of height to diameter or width does not exceed 2:1.

Full Breakdown

Sec. 300-2(A), Required, sets the parish's baseline permitting rule: any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert, or replace any electrical, mechanical, plumbing, or gas system regulated by the UDC, must first apply to the director and obtain the permit before doing or causing the work. The rule reaches essentially every category of construction activity, not just new buildings: additions, alterations, moves, demolitions, occupancy changes, and system replacements are all captured by the same sentence.

Subsection B then narrows that rule with a specific exemption list, framed so that exemptions do not authorize work that otherwise violates the UDC or any other law. Exempt building work includes one-story detached accessory structures under 200 square feet used as tool sheds, playhouses, or similar uses; fences not over 7 feet high; finish work such as painting, papering, tiling, and cabinetry; shade-cloth agricultural structures without service systems; playground equipment for one- and two-family homes; movable partitions under 5 feet 9 inches; grade-supported water tanks of 5,000 gallons or less with a height-to-width ratio no greater than 2:1; shallow prefabricated pools under 24 inches deep at single-family homes; and small window awnings. Parallel, shorter exemption lists cover minor electrical repairs and portable mechanical equipment. Everything outside those specific carve-outs, including new dwellings, additions, garages, commercial buildings, and system installations, needs a permit application to the director along with the construction documents required under Sec. 300-3 and the fees set in Sec. 300-4 before work starts.

Violations & Fines

Starting regulated work without the Sec. 300-2(A) permit exposes an owner or contractor to stop-work orders and fines under Sec. 300-8, which sets a $100-per-day fine for occupying a structure without a certificate of occupancy and a $50-per-day fine for job sites lacking required sanitary facilities, with fines running daily until compliance and stop-work orders reaching all of that contractor's active permits.

Frequently Asked Questions

What triggers a building permit requirement in St. Tammany Parish?
Sec. 300-2(A) requires a permit before anyone constructs, enlarges, alters, repairs, moves, demolishes, or changes the occupancy of a building or structure, or installs, alters, or replaces a regulated electrical, mechanical, plumbing, or gas system. The application goes to the director before the work starts, not after.
Is a small storage shed exempt from a building permit in the parish?
Yes, within limits. Sec. 300-2(B)(1)(a) exempts one-story detached accessory structures for single- and two-family homes used as tool or storage sheds, playhouses, or similar uses, as long as the floor area does not exceed 200 square feet. A larger shed needs a full permit.
What happens if someone occupies a new building without a certificate of occupancy?
Sec. 300-8(A) fines the contractor of record $100.00 per day until the violation is corrected, and the parish issues stop-work orders on all of that contractor's active permits until compliance is achieved.
