Summary

In unincorporated Worcester County, Maryland, it is unlawful to erect, locate, renovate, alter or demolish a building or structure, or even begin the excavation, until the Department issues a permit under § ZS 1-115. A permit expires if work has not begun within twelve months, or is not substantially complete within twenty-four months absent good cause.

These county ordinances apply to unincorporated areas of Worcester County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(a) Permit. It shall be unlawful to: ... (1) Erect or locate or begin the construction, reconstruction, extension, renovation, demolition or alteration, including the excavation thereof, of any building or structure until a permit for such work has been issued by the Department; or (2) Construct a well or sewage disposal system, including the reconstruction, replacement or extension of an existing well or sewage disposal system, until a permit for such work has been issued by the Department of the Environment. ... (g) Expiration. If the work described in any permit has not begun within twelve months from the date of issuance thereof, such permit shall thereupon expire. Thereafter, work shall not begin or continue until the applicant has filed for and received a new permit. If the work described in any permit has not been substantially completed within twenty-four months of the date of issuance thereof, such permit shall expire unless good cause can be shown to extend the same. The Department may grant a single twelve-month extension if such extension is justified. Expired permits shall become null and void.

Full Breakdown

Section ZS 1-115(a) of the Zoning and Subdivision Control Article makes two acts unlawful in unincorporated Worcester County. No one can erect, locate or begin the construction, reconstruction, extension, renovation, demolition or alteration of a building or structure, including the excavation, until the Department has issued a permit. No one can build or rebuild a well or sewage disposal system until the Department of the Environment has issued its permit. The Department is the County department the County Commissioners designate under § ZS 1-111. Separately, § BR 1-201 applies the Maryland Building Performance Standards to every building and structure, and every modification, that needs a permit, in all areas of the County except incorporated municipalities.

The application is filed on Department forms by the property owner, contract purchaser, option holder, lessee, or an attorney, contractor or agent. Anyone other than the owner needs the owner's cosignature. It must carry a site plan or plat drawn to scale showing property lines, required setbacks, existing buildings and the design, location and height of the proposed work. Section ZS 1-115(c) then holds the permit until other offices sign off: the Environmental Programs Division must approve the water supply and wastewater disposal systems, the County Department of Public Works or the State Highway Administration must approve driveways and drainage, and stormwater and sediment and erosion control plans must be approved where necessary. The Department is also not required to issue a permit until the applicant has corrected existing violations of the Code of Public Local Laws.

A permit authorizes only the use, arrangement and construction shown in the approved plans (§ ZS 1-115(h)). A finished building cannot be used until a zoning/occupancy certificate is issued under § ZS 1-115(b). A permit lapses after twelve months without a start and after twenty-four months without substantial completion unless good cause is shown, and the Department can grant a single twelve-month extension.

Violations & Fines

Under § ZS 1-120(b), a violation of the Zoning Article is a civil infraction unless the Article says otherwise, and the owner, tenant, architect, builder, contractor or agent who takes part can each be found guilty of a separate offense. The court is directed to order the violation removed or corrected, and the County can withhold or revoke a permit. The general civil infraction fine cap in § GP 5-102(e) is five hundred dollars, or one thousand dollars for a repeat offense.

Frequently Asked Questions

Do I need a permit to demolish a building in unincorporated Worcester County?
Yes. Section ZS 1-115(a)(1) lists demolition alongside erection, location, construction, reconstruction, extension, renovation and alteration, and it also covers the excavation. No one can begin any of that work until the Department has issued a permit for it, so demolition crews cannot start on a verbal go-ahead.
How long is a Worcester County building permit valid?
Work must begin within twelve months of issuance or the permit expires. If the work is not substantially completed within twenty-four months, the permit expires unless good cause is shown to extend it. The Department can grant a single twelve-month extension if justified. Expired permits are null and void, and a new permit is required before work resumes.
Does this permit rule apply inside Ocean City, Berlin, Snow Hill or Pocomoke City?
No. Section BR 1-201(a) applies the County building code in all areas of the County except incorporated municipalities. Ocean City, Berlin, Snow Hill and Pocomoke City run their own codes, so a project inside those town limits starts with the town. This page covers unincorporated Worcester County, Maryland only.
What approvals come before the Department issues the permit?
Under § ZS 1-115(c), the Environmental Programs Division must approve the water supply and wastewater disposal systems, and Public Works or the State Highway Administration must approve driveways and drainage structures. Stormwater and sediment and erosion control plans must be approved where necessary, and bonds can be required before issuance.
