Beaverton, OR Building Safety: Childcare Center Rules (2026)

BC 8.02.160 (the city's adopted, amended version of the Oregon Residential Specialty Code) provides that new "family childcare" and "foster care" uses defined in ORS Chapters 329A, 418 and 443, when located inside a detached one-family dwelling, are classified as Group R-3 occupancies -- the same building classification as an ordinary house -- rather than as a commercial or institutional use. Congregate living facilities are separately called out as needing to comply with the general Building Code. Notably, Beaverton's code also lists Appendix M (Home Day Care) among the appendices the state has NOT adopted and that a municipality may not adopt, so operators should not expect Appendix M-specific provisions to apply. This governs construction/occupancy classification inside Beaverton city limits, Washington County, Oregon; it does not address business licensing or state childcare licensing.
