44) and commercial child day care centers. 5 if it meets standards including: compliance with the zone's yard, height, setback and lot coverage rules; the home remaining the provider's principal residence with the care use clearly incidental to the residential use; a minimum of 75 square feet of outdoor activity space per ambulatory child (waivable if a public park or open space sits within a quarter mile); outdoor play equipment set at least five feet from the property line; a minimum six-foot solid wall or barrier enclosing outdoor play areas in urban residential zones; and a minimum 800-foot separation from any other large day care home or day care center, which the Director may waive on findings that the closer spacing will not harm surrounding properties, vehicular or pedestrian safety, or neighbors' noise exposure and privacy.

Commercial child day care centers must additionally take access only from a collector or arterial street, or a local street developed primarily with businesses, and must separate play areas from contiguous residential yards with a six-foot high solid masonry wall. Institutional child day care centers operated with a school, place of assembly, or other institutional use require a Conditional Use Permit unless the review authority finds the day care use incidental to the larger institutional use.
