Linden, NJ Building Safety: Childcare Center Rules (2026)

Linden treats childcare differently depending on where it happens. City Code § 31-2 defines 'home occupation' as an activity carried out for gain by a resident, conducted entirely within a dwelling unit and clearly incidental to residential use, but the definition specifically lists 'day care centers or nurseries' among the uses that do not qualify. A resident cannot simply open a daycare inside a house and call it a home occupation; the operation instead has to be sited as its own permitted use in a zone that allows it.

Two zones spell that out by name. Under § 31-45.2, 'day care centers, including nursery schools' are a permitted principal use in the SA-1 Core Transit Village Mixed-Use District near the Linden Railroad Station, alongside hotels and vocational and fine art schools. Under § 31-45.3, 'day care centers' are also listed as an additional permitted principal use in the SA-2 Transit Village Residential District, alongside single-family and two-family dwellings and home occupations on lots of five thousand square feet or more.

Once sited in a permitted zone, a childcare center has to meet the city's parking schedule. Section 31-27.19, 'Required Off-Street Parking Spaces,' assigns a childcare center one parking space for every two employees, a ratio added by Ordinance No. 65-1 on February 16, 2021, alongside separate ratios for self-storage facilities, assisted living facilities and nursing homes.

Before opening, an operator needs a building permit and Certificate of Occupancy from the Construction Official under §§ 31-35.1 through 31-35.3; the Construction Official cannot issue either if the proposed use or plans do not conform to Chapter 31.
