Full Breakdown

Sec. 50-42 mandates an NFPA 13 automatic sprinkler system and alarm system for new buildings in light or ordinary hazard occupancy classes that are three floors or more, exceed 35 feet, or exceed 15,000 square feet per floor, whenever a building permit is requested. Existing buildings expanded by less than 50 percent of their original floor area are not required to retrofit. The rule applies only in unincorporated Brevard; incorporated cities like Melbourne, Palm Bay, Titusville and Cocoa enforce their own fire codes.

Violations & Fines

Occupying a covered building without the required sprinkler and alarm system is a code violation enforceable under the fire prevention article's general penalty clause (§ 50-37, citing § 1-7), and the fire prevention bureau can withhold occupancy approval until the system passes inspection.

Frequently Asked Questions

Do single-family homes in Brevard need fire sprinklers?
No. Section 50-42 only requires them in buildings three floors or more, over 35 feet, or exceeding 15,000 square feet per floor: thresholds an ordinary house doesn't reach.
Does this rule apply in Melbourne or Palm Bay?
No. Chapter 50 governs unincorporated Brevard County only; Melbourne, Palm Bay, Cocoa and Titusville enforce their own separate fire codes.
Does adding a room to an older building trigger the sprinkler rule?
Only if the addition expands the building by 50 percent or more of its original floor area; smaller expansions are exempt from retrofitting under § 50-42.
