Wilmington follows the Delaware-adopted International Building Code and International Fire Code. Most new multifamily and commercial construction requires automatic fire sprinklers; one- and two-family homes generally do not.
Delaware adopts the International Building Code (IBC) and International Fire Code (IFC) statewide through the State Fire Marshal under Title 16 Β§6601. Wilmington Code Ch. 4 (Building) incorporates these rules. Sprinklers are required in apartments above a threshold size, hotels, dorms, healthcare facilities, and most commercial buildings. Single-family detached homes are not required to have sprinklers in Delaware, though they are encouraged. Substantial alterations and changes of occupancy can trigger sprinkler retrofit requirements. WFD and the State Fire Marshal jointly review plans.
Stop-work orders, denial of certificates of occupancy, and daily fines until corrective work passes inspection.
