Elevators in Wilmington buildings must be inspected and certified annually by the Delaware Department of Labor's Office of Boiler & Elevator Safety. Building owners must post valid certificates inside each car.
Delaware Code Title 19 Ch. 7 and the Office of Boiler Safety within the Department of Labor regulate elevator safety statewide, including Wilmington. Owners must hire licensed inspectors for annual safety tests, post current certificates inside cars, and complete five-year hydraulic and load tests. ASME A17.1 is the adopted standard. Wilmington L&I tracks compliance for buildings with active certificates of occupancy. Out-of-service elevators must be locked out and signed; multifamily owners must provide reasonable alternatives for tenants with disabilities under the federal Fair Housing Act.
DOL can shut down non-compliant elevators; fines accrue daily until repairs and certification are completed.
