Any scaffold more than 3 stories high or 36 feet above the base must have design and construction plans prepared by a California-licensed civil or structural engineer. All scaffolds must be erected on sound footing, be plumb and square, and have guardrails at 42 inches plus midrails at 21 inches and toeboards at least 4 inches tall on all open sides and ends when the working platform is 7.5 feet or more above the ground. Planking must be scaffold grade and fully decked. A qualified competent person must inspect each scaffold before every work shift and after any event that could affect integrity. Fall protection on scaffolds requires personal fall arrest systems above 7.5 feet on most systems. Contractors must provide a scaffold user training program under Title 8 CCR 1637. Santa Clara County Permit Center does not separately permit scaffolds but county inspectors flag Cal/OSHA referrals when they see unsafe conditions. Fatal or serious injuries must be reported to Cal/OSHA within 8 hours under Labor Code 6409.1, and penalties range from 15625 dollars for general violations to 156259 dollars for willful or repeat violations.
