Full Breakdown
Section 34-611(e) of the Land Development Code applies its dimensional standards to all permitted, conditional and accessory uses in the RS-1 zoning district. For a single-family dwelling unit, subsection (e)(1)e limits lot coverage by the primary structure and required driveway to thirty-five percent, and subsection (e)(1)f limits impervious surface to fifty percent. Because the first measure counts only the primary structure and the required driveway, the fifty percent impervious cap is the figure that reaches pools, patios, walks and other hard surfaces.
The same two numbers repeat across the other single-family districts. RS-2 prints thirty-five percent lot coverage for the primary structure and required driveway and fifty percent impervious surface, and RS-3 and the single-family portion of RM-1 do the same. RS-2 pairs them with a six thousand square foot minimum lot area, RS-3 with five thousand square feet.
The RM-1 district separates its housing types. Townhouses of up to two units per building keep thirty-five percent lot coverage and fifty percent impervious surface. Townhouses of three to four units per building are allowed fifty percent lot coverage and sixty-five percent impervious surface. Multi-family dwellings in RM-1 have a maximum lot coverage of sixty-five percent.
Coverage works alongside the yard rules. RS-1 also requires a twenty-five foot front yard, ten foot side yards and a thirty foot rear yard, and accessory structures sit in a side or rear yard five feet from lines and other structures. Section 34-716(c) separately limits the combined ground floor area of enclosed, detached accessory buildings in a residential district to six hundred twenty-five square feet.
The RS-1 section also sends other standards to separate divisions of Article VII: off-street parking and loading in division 1, supplemental standards in division 2, landscape standards in division 3, signs in division 4 and environmental standards in division 5.
Violations & Fines
Exceeding a coverage or impervious limit is a Land Development Code violation heard by the special magistrate under section 34-1202. The planning and development department notifies the owner with a minimum of ten working days to correct, then issues a final notice of violation. At the hearing the city must show the violation by a preponderance of the evidence, and the order can include a fine if compliance is missed.
