Full Breakdown

Section 34-728 states its purpose as preserving attractive residential areas and promoting safe, unimpeded traffic circulation. Subsection (a) applies to any public street right-of-way or approved private street easement contiguous to a residentially zoned property, or residentially used property in an RD or PUD district. Two items matter for trucks: (a)(4), any semi-trailer truck or cab, and (a)(5), any commercial vehicle which measures in excess of twenty (20) feet in total body length, seven (7) feet in total width or seven (7) feet in total height, including appurtenances, equipment or cargo. Exceeding any one of the three dimensions triggers the ban, and ladders, racks and cargo count toward the measurement.

Subsection (c) goes further on the lot itself. No garbage truck, pump-out truck, chemical truck, gasoline truck, fuel oil truck or similar vehicle designed to transport wastes or hazardous or noxious materials can be parked or stored on any residentially zoned property or residentially used property in an RD or PUD district. Subsection (b)(6) repeats the same size test for the required setback area on the lot.

Subsection (g) sets the exceptions. The restrictions do not apply to commercial vehicles during the actual performance of a service at the premises where it is parked, or to loading, unloading or cleaning completed in forty-eight (48) hours. Vehicles parked before the rule are not grandfathered: subsection (g)(3) applies the restrictions regardless of the date parking commenced and says it is not an allowable nonconforming use under section 34-1101.

A separate traffic rule, § 31-39, bars oversized vehicles (more than 22 feet long or 10,000 pounds GVWR or more) from city streets, rights-of-way and city lots between A1A (Third Street) east to the bulkhead line and from Sixteenth Avenue South to Sixteenth Avenue North. Loading is authorized there from 8:00 a.m. to 8:00 p.m., violators face towing at the owner's expense without prior notice, and the penalty is a fine of fifty dollars ($50.00) per violation plus a late fee of ten dollars ($10.00) if unpaid.

Violations & Fines

Section 34-728 restrictions are enforced under article XII of the Land Development Code. The Planning and Development Department gives a first notice with a minimum of ten (10) working days to correct, then a final notice of violation and a hearing before the special magistrate under § 34-1202. For the oversized-vehicle zone in § 31-39, the penalty is a $50.00 fine per violation, payable within ten (10) days, with a $10.00 late fee, and the vehicle is subject to being towed at the owner's expense without prior notice.

Frequently Asked Questions

Can I park my work truck on a residential street in Jacksonville Beach?
Not if it measures more than twenty (20) feet in body length, seven (7) feet in width or seven (7) feet in height, counting equipment or cargo. Section 34-728(a)(5) bars those commercial vehicles from the street right-of-way next to residential property. A smaller van or pickup does not hit that size test.
Are semi-trailer trucks allowed in residential neighborhoods?
No. Section 34-728(a)(4) bars any semi-trailer truck or cab from being parked or stored on a street right-of-way next to residential property, and (b)(5) bars one from the required setback area on residential lots in the same districts.
Can a plumber or contractor park a truck at a house while working?
Yes. Subsection (g)(1) says the parking restrictions do not apply to commercial vehicles during the actual performance of a service at the premises where it is parked. Loading, unloading or cleaning is also exempt if fully completed in forty-eight (48) hours.
Can I keep a fuel or septic truck at home?
No. Subsection (c) bars any garbage truck, pump-out truck, chemical truck, gasoline truck, fuel oil truck or similar vehicle designed to transport wastes or hazardous or noxious materials from being parked or stored on residentially zoned property or residentially used property in an RD or PUD district.
