Full Breakdown
Section 31-33 splits curbside loading into two kinds of marked places. Subsection (a) covers a passenger zone: no one can stop, stand or park for any purpose or period of time other than the expeditious loading or unloading of passengers, during the hours when the regulations for that passenger zone are effective, and then only for a period not to exceed three (3) minutes. Subsection (b) covers a loading zone for materials: no one can stop, stand or park other than for the expeditious unloading and delivery or pickup and loading of materials, during the hours when the provisions applicable to loading zones are in effect. In no case can the stop exceed thirty (30) minutes.
The section ties both rules to the hours posted for the zone and prints no clock times of its own. Sec. 31-3(a)(1) gives the chief of police, with the consent of the city manager, power to designate areas where parking is prohibited or limited by signs, signals, markers and markings. Sec. 31-3(b) adds that yellow paint or markings on any street or curbing mean parking is prohibited in that area, except that an area marked with yellow paint and designated as a loading zone can be used for that purpose or for whatever purpose it is designated.
Two neighboring sections matter to delivery drivers. Section 31-35 keeps buses and taxicabs to their stops and stands, and lets a passenger-vehicle driver temporarily stop in a bus stop or taxicab stand only while actually loading or unloading passengers and only if that does not interfere with a bus or taxicab waiting to enter. Section 31-72 reserves the city's power to provide for the loading or unloading of trucks, vans or other commercial vehicles.
Off-street loading is a zoning matter under Sec. 34-710. Uses that require the receipt or distribution of a large volume of materials or merchandise by vehicles, excluding uses in the CBD, provide off-street loading spaces on a floor-area table that starts at one space for 5,000 to 20,000 square feet. Each space has direct access to an alley or street and measures forty (40) feet long, twelve (12) feet wide and, if covered, fourteen (14) feet high.
Violations & Fines
Section 31-33 prints no penalty of its own. Where an act is made unlawful and no specific penalty is provided, Sec. 1-11(a) sets a fine not exceeding $500.00 or imprisonment not exceeding ninety (90) days, or both. The parking fee schedule in Sec. 31-74(a) lists parking prohibited area and improper parking at $25.00 within ten days and $35.00 after the due date.
