Full Breakdown
Section 34-728 of the Land Development Code applies to residentially zoned property and residentially used property in an RD or PUD district. Its stated purpose is preserving attractive residential areas and promoting safe, unimpeded traffic circulation.
Street right-of-way, subsection (a). No boat or boat trailer, no hauling trailer, and none of the travel trailers, motor homes and camping trailers may be parked or stored on any public street right-of-way or approved private street easement contiguous to such property. Subsection (a) also reaches semi-trailer trucks or cabs and any commercial vehicle over twenty (20) feet in body length, seven (7) feet in width or seven (7) feet in height.
Setback area, subsection (b). Nothing in the list may be parked or stored, in whole or part, within the required setback area from a street right-of-way or approved private street easement. That covers more than two (2) boats per residential lot, any boat over twenty (20) feet in length, any hauling trailer except trailers mounted with boats twenty (20) feet or less, and travel trailers, motor homes and camping trailers.
Occupancy and temporary permits. Under (d), a trailer or camper may not be occupied during parking or storage except for repair or maintenance, and occupied includes electrical, water, sewer or telephone connections as well as personal occupancy day or night. Under (f), an owner who wants to temporarily occupy a travel trailer, motor home or camping trailer stored as permitted under (b) must apply to the planning and development department. No permit runs longer than thirty (30) consecutive calendar days or more than thirty (30) calendar days in a calendar year for the same property, and it is issued only where the owner lives in the primary residence and active permitted construction is taking place there.
Exception and grandfathering, subsection (g). The restrictions do not apply to loading, unloading or cleaning of vehicles completed in forty-eight (48) hours. Parking that began before the rule is not an allowable nonconforming use under section 34-1101.
Violations & Fines
Section 34-728(g) says the parking restrictions are enforced in accordance with article XII, division 1 of the Land Development Code. The section as printed does not state a fine amount. Because (g)(3) denies nonconforming-use protection, a boat or trailer parked in the same spot for years is still subject to enforcement.
