Full Breakdown
Section 31-34 is the free-movement rule. Subsection (a) forbids stopping, standing or parking on a street, other than an alley, in a way that leaves available less than ten (10) feet of the width of the roadway. A driver can stop temporarily during the actual loading or unloading of passengers, or when necessary in obedience to traffic regulations, traffic signs or signals, or a police officer. Subsection (b) covers alleys: no one can park within an alley for over fifteen (15) minutes unless not less than eight (8) feet of the width of the roadway stays available.
Other sections in Chapter 31 fill in the rest. Section 31-32 bars standing or parking on a roadway for the principal purpose of displaying a vehicle for sale, or washing, greasing or repairing it, except repairs necessitated by an emergency. Section 31-60 directs the city manager to mark off individual parking spaces on any city street, and at a marked space it is unlawful to park so that the vehicle is not entirely within the limits of the space. Under Sec. 31-3(b), yellow paint or markings on any street or curbing mean that parking is prohibited in the marked area, unless the area is designated as a loading zone. Under Sec. 31-37, no person can allow any vehicle registered in his name to stand or park in any street in violation of the city's parking ordinances, so the registered owner answers for the violation.
The Police Department enforces the parking-regulation division (Sec. 31-71). The fee schedule in Sec. 31-74(a) lists overtime parking, parking prohibited area, parking within 15 feet of a fire hydrant, improper parking, parking double, obstructing traffic, obstructing driveway and parking in a designated fire zone, each at $25.00 if paid within ten days and $35.00 if not paid by the due date. Unauthorized parking in a handicapped zone is $250.00 and $260.00 on the same two tracks. Fees are paid to the City Clerk at City Hall, Jacksonville Beach, Florida.
Violations & Fines
Under Sec. 31-74(b), a violation of the parking-regulation division, or counseling, aiding or abetting one, is an offense punished by a fine not to exceed $100.00 or imprisonment not to exceed thirty (30) days, either or both at the court's discretion. Under Sec. 31-46(a)(1), the chief of police or any police officer can impound a vehicle unlawfully parked at that place or time. Four or more citations outstanding over thirty (30) days support immobilization under Sec. 31-56.
