Summary

In the City of Marion, Ohio, principal and accessory buildings in the O-I Office and Institutional District shall not occupy more than 25% of the area of a lot under § 1151.022. The O-I-A district adopts the same coverage standard, and a separate 25% cap applies to accessory buildings in a residential rear yard.

Principal and accessory buildings shall not occupy more than 25% of the area of a lot.

Full Breakdown

Chapter 1151 of the Marion Codified Ordinances sets lot coverage for the office districts. Section 1151.02 says lot size, lot coverage, floor area ratio, yard and building height requirements for all office and institutional districts are set in the sections that follow. The coverage rule itself is one sentence in § 1151.022: principal and accessory buildings together shall not occupy more than 25% of the area of a lot. It counts buildings only. The section says nothing about driveways, parking areas or paving.

Lot size works backward from coverage. Section 1151.021 sets no minimum lot size or dimensions, but the lot must be adequate to comply with the maximum coverage and minimum yard requirements. Intensity is also capped by floor area ratio under § 1151.023: the ratio of floor area to lot area shall not exceed 0.5, rising to 1.0 where an O-I lot adjoins land in the R-3 Multi-family District along 1/2 or more of its total perimeter. Section 1151.03 gives the O-I-A Office-Institutional-Apartment District the same lot coverage requirements as O-I and lets the ratio reach 1.4 for buildings exclusively for elderly housing limited to that use by legally binding agreements or other documents.

Residential districts use a different set of controls. The § 1151.011(A) schedule lists minimum lot size, lot area per dwelling unit, maximum floor area ratio, minimum yards and maximum building height, and § 1159.01(B)(4) separately limits coverage of a rear yard by accessory buildings to 25%.

Coverage is checked at the zoning permit stage. The § 1177.02 application must show the actual shape and dimensions of the lot and the exact location, size and height of each building, drawn to scale, and the Safety/Service Director can require the lot dimensions to be based on an actual survey. For a non-residential project the § 1183.011 permit fee is a minimum of $25.00 plus $1.50 per additional $1,000 or fraction thereof, with a maximum of $1,000.

Violations & Fines

Section 1127.99 makes it unlawful to locate, erect, construct, enlarge, maintain or use any building or land in violation of the zoning code. A first offense is a minor misdemeanor with a fine of not more than $100. A second offense within one year is a fourth-degree misdemeanor, punishable by not more than 30 days in jail and/or $250. Each later offense within one year is a third-degree misdemeanor, punishable by not more than 60 days in jail and/or $500.

Frequently Asked Questions

What is the maximum lot coverage in Marion's office districts?
Principal and accessory buildings shall not occupy more than 25% of the area of a lot, per § 1151.022. The standard covers the O-I district and, through § 1151.03, the O-I-A district. The Safety/Service Director enforces it when reviewing the plans filed with a zoning permit application.
Does the 25% rule apply to houses in Marion's residential districts?
No. Section 1151.022 sits in the O-I Office and Institutional District group of sections. Residential lots are governed by the § 1151.011(A) schedule, and accessory buildings in a residential rear yard are limited by § 1159.01(B)(4) to 25% coverage of the rear yard.
Is there a floor area limit in addition to lot coverage?
Yes. Section 1151.023 caps the floor area ratio at 0.5, rising to 1.0 where an O-I lot adjoins R-3 Multi-family land along 1/2 or more of its perimeter. Under § 1151.03, buildings in O-I-A used exclusively for elderly housing under binding agreements can reach 1.4.
Who can grant relief from the coverage limit?
The Board of Zoning Appeals hears variance requests under § 1171.03. It must find peculiar circumstances, practical difficulty and unnecessary hardship, that the variance is the minimum that allows reasonable use, and that it is in harmony with the code. The fee is on the schedule kept by the Clerk of Council under § 1183.015.
