Small Town Character Overlay District (Sec. 5.1.5) single-family: 60 ft width, 20 ft front, 8 ft side (10 ft on side with driveway), 15 ft rear, 10 ft corner, 36 ft height, 50% BUA, 6 units/acre. Detached accessory structures (UDO Sec. 5.2.7): 5 ft minimum side and rear setback, must sit behind the principal building unless 60+ ft from front line, no more than 35% of required yard, 10 ft minimum from principal building, height max 5 ft above principal. Encroachments (Sec. 5.2.2.B.4): attached decks 50% into rear setback; unenclosed porches 50% into front or rear; cantilevers 6 ft into front/rear (3 ft minimum to line, no side encroachment); appurtenances (chimneys, eaves, bay windows, solar) 3 ft into any setback. Variances require Apex Board of Adjustment approval under UDO Article 2 and NCGS Β§ 160D-705 with a hardship finding.
Setback violations are enforced by Apex Planning under NCGS Β§ 160D-404 and Β§ 160D-1119 with notice of violation, daily civil penalties under UDO Article 11, and equitable relief in Wake County Superior Court. Building without a required permit triggers an Apex Building Inspections stop-work order, double permit fees, and possibly an order to remove or relocate the offending portion of the structure.
