Full Breakdown

Each zoning district in Appendix B of the City of Burleson Code of Ordinances prints its own yard minimums. In § 57-120 for the SF7, single-family dwelling district-7, the depth of front yard is 25 feet minimum, the depth of rear yard is ten feet minimum, the width of side yard is five feet minimum, and the width of side yard adjacent to a side street is 15 feet minimum. The lot must be 60 feet wide and 100 feet deep minimum, and schools or churches need a 25 feet minimum side yard on either side of the main building.

Other districts differ. The A, agricultural district in § 52-120 requires a 35 feet front yard, no rear yard, ten feet on each side and 15 feet adjacent to a street. The C, commercial district in § 78-120 requires a 20 feet front yard, ten feet in the rear and on the side where the lot is adjacent to a residential district, and ten feet on a side street.

Section 132 applies to every district. The front yard is measured from the property line to the front face of the building, covered porch, covered terrace or attached accessory building, and eave and roof extensions can project into it for a distance not to exceed four feet. Side yards must stay open except for architectural features projecting not more than 12 inches and roof eaves projecting not more than 36 inches. Detached accessory buildings sit in the rear yard. A residential accessory building needs a three feet side yard, ten feet adjacent to a side street, and three feet from the rear lot line, and it cannot be closer than six feet to the main building. A garage or carport entered from an alley or side street is set back a minimum of 18 feet.

Relief is narrow. Under § 13-110 the administrative official can waive up to 15 percent of a required yard for an existing structure with a certificate of occupancy that encroaches because of a survey or construction error, but never for signs, fences, parking or building height.

Violations & Fines

Building into a required yard conflicts with § 14-100, which requires structures to be placed in conformance with the zoning regulations of the district. Under § 1-14(b) of the Code, the maximum fine for violating zoning provisions is $2,000.00, and under § 1-14(c) each day a violation continues is a separate offense.

Frequently Asked Questions

How far must a house sit from the street in an SF7 lot?
Section 57-120 sets the SF7 depth of front yard at 25 feet minimum. Under § 132-105(c) the front yard is measured from the property line to the front face of the building, covered porch, covered terrace or attached accessory building, and eave and roof extensions can project into it for a distance not to exceed four feet.
What is the setback on a corner lot?
In the SF7 district, § 57-120 requires 15 feet minimum for the width of side yard adjacent to a side street. In the A district the figure is 15 feet minimum adjacent to a street, and in the C district it is ten feet minimum on a side street, so the district decides.
How close can a shed or detached garage be to the property line?
Under § 132-115, a residential accessory building needs a side yard of three feet from the side lot line, ten feet adjacent to a side street, and a rear yard of not less than three feet. Detached accessory buildings in the rear portion cannot be closer than six feet to the main building.
Can I get relief if my building encroaches on a setback?
Two routes exist. The administrative official can approve a waiver of up to 15 percent of a required yard under § 13-110, only for an existing structure with a certificate of occupancy, and never for signs, fences, parking or building height. The board of adjustment can grant a variance where literal enforcement would cause unnecessary and undue hardship.
