Summary
Unincorporated Brazoria County has no zoning, so lot setbacks come entirely from the county's Subdivision Regulations. Section 4.02.F sets the building line at 25 to 40 feet from the right-of-way depending on whether the road is a Local street, Collector, or Thoroughfare, plus a flat 10-foot side and rear setback the County Engineer checks before certifying any plat.
F. Setback Lines
1. All Lots fronting public Right-of-Way and private access Easements shall have the appropriate setbacks in accordance with the classification of the road that they are fronting. These setbacks are as follows: Table 4-2. Setback from Right-of-Way: Thoroughfare Type / Setback from Right-of-Way - Thoroughfare 40 feet; Collector 35 feet; Local 25 feet. 2. Building Setback Lines must be established a minimum of fifteen (15) feet on each side of and parallel to the centerline of any pipelines, pole lines, or other Utility facilities located in such undefined Easement. 3. All Lots shall have a minimum side and rear setback of ten (10) feet.
Full Breakdown
F, Setback Lines. Every lot platted since that date must meet a setback measured from the road right-of-way that scales with the road's classification: 40 feet along a Thoroughfare, 35 feet along a Collector, and 25 feet along a Local street, per Table 4-2. Every lot also carries a flat minimum side and rear setback of 10 feet, and a separate 15-foot building setback applies on each side of the centerline of any pipeline, pole line, or other utility facility crossing an undefined easement. Where a lot line borders an existing or planned Thoroughfare and the applicant is not required to dedicate right-of-way at the time of platting, the County Engineer's Development division can require a larger setback than the table calls for, preserving the county's ability to buy that right-of-way later at fair market value before it is built over.
These figures apply only to platting in the unincorporated county; Angleton, Alvin, Freeport, and the county's other cities set their own building lines through their own zoning codes, not through this document. Because the county issues no zoning permits, the setback line is checked when the County Engineer reviews and certifies the plat, not through a separate building-permit inspection, so a noncompliant lot layout is caught before the plat reaches the Commissioners Court for final approval.
Violations & Fines
The County Engineer certifies on the face of every plat that it complies with all existing rules and regulations of the county as adopted by Commissioners Court, and the Commissioners Court's own approval signature block follows that certification. A plat showing a lot that violates the Table 4-2 right-of-way setback, the 10-foot side/rear minimum, or the 15-foot utility-easement setback is not certified, so it is not approved and cannot be recorded until the layout is corrected or a variance is granted.
