Spotsylvania County zoning sets minimum setbacks for the R-1 (Suburban Residential) district at 35 feet front, 15 feet side (35 feet total combined), and 35 feet rear, per Code of Ordinances Chapter 23 (Zoning). R-2 (Urban Residential) reduces front and rear setbacks to 30 feet and 25 feet respectively. Accessory structures over 256 square feet require a zoning permit from the Spotsylvania County Zoning Division.
Spotsylvania County Code of Ordinances Chapter 23, Article III, sets dimensional standards by zoning district. R-1 Suburban Residential requires a 35-foot front setback from any street right-of-way 50 feet or wider (or 60 feet from centerline of narrower rights-of-way), minimum 15-foot side yards on each side with the combined total at least 35 feet, and a rear yard of at least 35 feet. R-2 Urban Residential standards are 30-foot front, 10-foot side / 25-foot combined, and 25-foot rear. Setbacks are measured from the property line to the foundation of the principal structure. Accessory structures (sheds, detached garages) less than 256 sq ft and 14 feet tall may be located up to 10 feet from rear and side property lines per Chapter 23 Β§23-7.2. The county is updating Chapter 23 β Articles 4-8 of the Zoning Ordinance and Design Standards Manual are in revision as of 2026 β so applicants should confirm current standards with the Zoning Division (540-507-7434).
Construction inside required setbacks without a variance is a Class 1 misdemeanor under Virginia Code Β§15.2-2286 and Spotsylvania County Code Β§23-15, carrying fines up to $2,500 and injunctive relief requiring demolition of the non-conforming portion. After-the-fact variance applications go to the Board of Zoning Appeals and require demonstrating hardship.
