Chapter 15.48 gives the City Council authority to fix, by ordinance, the minimum distance back of a street line within which no building or structure may be erected 'whenever the public peace, health, safety, comfort, convenience, interest or welfare may so require' (§15.48.030). The process starts with a verified petition filed with the Council describing the street and the proposed line, accompanied by a sketch showing the street and lot lines (§15.48.020). Before ordering a line established, the Council must pass a resolution of intention, publish it once in the official newspaper, and post two copies at least one hundred feet apart on each block of the affected street; the hearing on objections must be set no fewer than fifteen and no more than thirty days after the resolution, with publication and posting completed at least ten days before the hearing (§15.48.040).

While that resolution is pending and before the establishing ordinance takes effect, no building permit may be issued for construction between the proposed line and the street line, and any permit issued anyway is void (§15.48.050). Property owners may file written protests with the City Clerk up to the hearing hour; the Council can then abandon the proceeding, adopt the line as proposed, or modify it, and its decision is final (§15.48.060). For chapter purposes, 'building' and 'structure' exclude a coping, a fence no higher than three feet, a retaining wall, or a walk or stairway to the building (§15.48.010).

Once a setback line ordinance takes effect, §15.48.070 makes it unlawful to construct or place any building, wall, fence or other structure in the space between the street line and the setback line, and directs the Building Inspector to refuse any permit for that space.
